What is this Privacy Policy?

We would like to explain in detail how we process your personal data so that you can have full knowledge and feel comfortable when using our website. Since we operate in the online industry ourselves, we know how important the protection of your personal data is. That is why we make special efforts to protect your privacy and the information you provide to us. We carefully select and apply appropriate technical measures, in particular software‑based and organisational safeguards, to ensure the protection of the personal data we process. Our website uses encrypted data transmission (SSL), which protects data that identifies you. Which legal act governs the processing of your personal data?

Your personal data is collected and processed by us in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119, p. 1), commonly referred to as the GDPR. In matters not regulated by the GDPR, the processing of personal data is governed by the Polish Personal Data Protection Act of 10 May 2018.

What personal data do we process and for what purposes?

On our website, we offer you various services. For each of these services we process different types of personal data, based on different legal grounds.

Purpose: conclusion and performance of a sales contract for goods
Scope of data: first name, last name, mailing address, VAT ID (NIP), e‑mail address, phone number, bank account number, payment card number
Legal basis: Article 6(1)(b) GDPR – processing in order to take steps at your request prior to entering into a contract and processing necessary for the performance of a contract to which you are a party
Retention period: until the expiry of the limitation period for claims related to the performance of the contract

Purpose: contact form
Legal basis: Article 6(1)(f) GDPR – processing for the purposes of our legitimate interest consisting in responding to your message
Retention period: until you object to the processing of your personal data or until it is established that your data has become outdated

Purpose: establishment, exercise and enforcement of claims and defence against claims in proceedings before courts and other public authorities
Scope of data: first name, last name, mailing address, PESEL number, VAT ID (NIP), REGON, e‑mail address, phone number, IP address, bank account number, payment card number
Legal basis: Article 6(1)(f) GDPR – processing for the purposes of our legitimate interest consisting in establishing, pursuing and enforcing claims and defending against claims in proceedings before courts and other public authorities
Retention period: until the expiry of the limitation period for claims related to the performance of the contract

Purpose: fulfilment of legal obligations arising from legal provisions, in particular tax and accounting regulations
Scope of data: first name, last name, company name, PESEL number, VAT ID (NIP) or REGON, e‑mail address, phone number, mailing address, bank account number, payment card number
Legal basis: Article 6(1)(c) GDPR – processing is necessary for compliance with a legal obligation to which the controller is subject, in particular obligations arising from tax and accounting regulations
Retention period: until the expiry of the legal obligations incumbent on the controller which justify the processing of personal data

Purpose: analysis of traffic on the online store website
Scope of data: IP address, location, information stored in cookies
Legal basis: Article 6(1)(f) GDPR – processing for the purposes of the controller’s legitimate interest consisting in analysing customer traffic on the store’s website
Retention period: for 26 months from the date of data collection or until you object to the processing of your personal data

Purpose: direct marketing of our own goods and services, including remarketing
Scope of data: first name, last name, company name, mailing address, e‑mail address, phone number, IP address, information stored in cookies, location, order history
Legal basis: Article 6(1)(f) GDPR – processing for the purposes of the controller’s legitimate interest consisting in direct marketing of its own services, including remarketing
Retention period: until you object to the processing of your personal data or until it is established that your data has become outdated

Voluntary nature of providing personal data

Providing the required personal data is voluntary, but it is a condition for us to be able to provide services to you (for example, to create an account).

Automated decision‑making (including profiling)

We use tools that enable us to serve personalised advertisements to you. Based on the actions you take in the store, in particular the content you view and the time you spend on individual subpages, we adjust and display marketing content tailored to you. Thanks to such profiling, we can direct marketing messages that are more relevant to you, which benefits both you and us, as it reduces the amount of marketing content concerning goods and services that are outside your area of interest.

Facebook Inc. is listed in the register of entities participating in the Privacy Shield programme (link: https://www.privacyshield.gov/participant?id=a2zt0000000gnywaac&status=active), which means that the level of personal data protection is adequate in relation to the regulations in force in the European Union, in accordance with Commission Implementing Decision (EU) 2016/1250 of 12 July 2016 on the adequacy of the protection provided by the EU‑US Privacy Shield (link: https://eur-lex.europa.eu/legal-content/PL/TXT/HTML/?uri=CELEX:32016D1250&from=EN).

In order to use Google tools for creating statistics, profiling customers and carrying out marketing and remarketing activities, your personal data may be transferred to the United States, where Google’s servers are located. Google LLC is listed in the register of entities participating in the Privacy Shield programme (link: https://www.privacyshield.gov/participant?id=a2zt000000001l5AAI&status=active), which means that the level of personal data protection is adequate in relation to the regulations in force in the European Union, in accordance with Commission Implementing Decision (EU) 2016/1250 of 12 July 2016 on the adequacy of the protection provided by the EU‑US Privacy Shield (link: https://eur-lex.europa.eu/legal-content/PL/TXT/HTML/?uri=CELEX:32016D1250&from=EN).

What rights do you have in connection with our processing of your personal data?

Under the GDPR you have the right to:
– request access to your personal data,
– request rectification of your personal data,
– request erasure of your personal data,
– request restriction of processing of your personal data,
– object to the processing of your personal data,
– request portability of your personal data.

If you submit any of the above‑mentioned requests to us, we will provide you with information about the actions taken in connection with your request without undue delay and in any event within one month of receiving the request. If necessary, we may extend this one‑month period by a further two months due to the complexity of the request or the number of requests. In any case, we will inform you within one month of receiving the request of any such extension and the reasons for the delay.

Right of access to personal data (Article 15 GDPR)

You have the right to obtain information as to whether we process your personal data. If we do process your personal data, you have the right to:
– access your personal data;
– obtain information about the purposes of processing, the categories of personal data concerned, the recipients or categories of recipients of the data, the envisaged period for which your data will be stored or the criteria used to determine that period, the rights you have under the GDPR and the right to lodge a complaint with the President of the Personal Data Protection Office, the source of the data, automated decision‑making, including profiling, and the safeguards applied in connection with the transfer of the data outside the European Union;
– obtain a copy of your personal data.

Right to rectification of personal data (Article 16 GDPR)

If your personal data is inaccurate, you have the right to request that we rectify it without undue delay. You also have the right to request that we complete your personal data. Right to erasure of personal data (“right to be forgotten”, Article 17 GDPR)

You have the right to request the erasure of your personal data where:
– your personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
– you have withdrawn a particular consent, to the extent that the personal data was processed based on your consent;
– your personal data has been processed unlawfully;
– you have objected to the processing of your personal data for direct marketing purposes, including profiling, to the extent that the processing is related to such direct marketing;
– you have objected to the processing of your personal data in connection with processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of legitimate interests pursued by us or by a third party.

Right to request restriction of processing (Article 18 GDPR)

You have the right to request restriction of the processing of your personal data where:
– you contest the accuracy of your personal data – in such a case we will restrict processing for a period enabling us to verify the accuracy of the data;
– the processing is unlawful and, instead of erasure of the personal data, you request restriction of its use;
– your personal data is no longer needed for the purposes of the processing, but is required by you for the establishment, exercise or defence of legal claims;
– you have objected to the processing of your personal data – pending verification whether our legitimate grounds override the grounds for your objection.

Right to object to processing (Article 21 GDPR)

You have the right to object at any time to the processing of your personal data in connection with:
– processing necessary for the performance of a task carried out in the public interest or processing necessary for the purposes of legitimate interests pursued by the controller or by a third party;
– processing for direct marketing purposes.

Right to data portability (Article 20 GDPR)

You have the right to receive your personal data from us in a structured, commonly used and machine‑readable format and to transmit those data to another controller. As a rule, we will provide your personal data in CSV format. If you prefer the data to be provided in a different format, please indicate your preferred format in your request. Where possible, we will try to provide the data in your preferred format. You may also request that we transmit your personal data directly to another controller, where technically feasible. Complaint to a supervisory authority

If you believe that the processing of your personal data infringes data protection laws, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement. In Poland, the supervisory authority within the meaning of the GDPR is the President of the Personal Data Protection Office, who replaced the Inspector General for Personal Data Protection (GIODO) on 25 May 2018. Cookies: general information

When you browse the pages of the online store, “cookies” are used – these are small text files that are stored on your end device in connection with your use of the store. Their use is intended to ensure the correct functioning of the online store pages. These files make it possible to identify the software you use and to tailor the online store individually to your needs. Cookies usually contain the name of the domain from which they originate, the time they are stored on the device and a value.

Security

The cookies we use are safe for your devices. In particular, it is not possible for viruses or other unwanted or malicious software to get onto your devices via cookies.

Types of cookies

We use two types of cookies:
– session cookies: these are stored on your device and remain there until the end of a given browser session. The stored information is then permanently deleted from your device’s memory. The mechanism of session cookies does not allow any personal data or any confidential information to be retrieved from your device.
– persistent cookies: these are stored on your device and remain there until they are deleted. Ending the session of a given browser or switching off the device does not cause them to be deleted from your device. The mechanism of persistent cookies does not allow any personal data or any confidential information to be retrieved from your device.
